KARACHI: The Sindh High Court (SHC) on Friday put managing director Karachi Water and Sewerage Board (KWSB), chairman Sindh Public Procurement Regulatory Authority (SPPRA) and chief secretary Sindh on notice for declaring a constructor not pre-qualified for construction work.
The petitioner Muhammad Ayub and brothers cited managing director KWSB, chairman SPPRA, and province of Sindh through chief secretary as respondents. Petitioner submitted that KWSB had invited applications for the pre-qualification of construction work on September 15, 2009 in which he said that he had applied for and was subsequently pre-qualified for this work.He stated that construction works never went into bidding stages and was cancelled by the competent authority despite he had qualified for it.
He said that again applications through advertisement were invited for same construction work where he was informed by the KWSB that he was not pre-qualified for the construction work. Therefore, he prayed court to declare the act of respondents of declaring him not pre-qualified illegal. He pleaded to court to direct the respondents to issue fresh qualification process for upcoming group works. The division bench headed by Justice Irfan Saadat Khan issued notice to respondents and put off the hearing till January 22. ppi
